Terms and Conditions

Preamble :

STARTING BLOCKS (trade name MI-MAI) is the seller of products and services on the site. The commercial site www.mi-mai.com (hereinafter "Le Site") is an e-commerce site accessible via Internet,open to any user of the network. It is operated by Starting Blocks, Limited (hereinafter referred to as Starting Blocks), SARL with a capital of 8 000 euros, whose registered office is 83 rue vieille du temple, 75003 Paris registered in the Register of Paris under number 500 976 998, Vat number intra FR08 500 976 998. 

The Site enables Starting Blocks to offer its products (hereinafter "Products") for sale in France and abroad. The Site is reserved for individuals and prohibits traders. 
These Terms and Conditions (hereinafter "Terms") govern your use of the Site and Services (hereinafter "Services") that may be proposed and would be out buying from the Site. Any use of the Site constitutes full acceptance by the Customer of these Terms. Acceptance of Terms is done by checking the "I agree fully with the Terms and Conditions of Sale" when creating an account. This acceptance is necessarily full, acceptance subject is null and void. In case of modification of these Terms, the Terms and Conditions that apply are those in effect on the date of use of the Services or the order. The present CGV is available for consultation in French and in English. In case of difference between both versions, it is the French version which prevails.

Art.n°1 : Products

The essential characteristics of products are available on the website in each sheet products. The client is fully aware that the images, photos and colors of the items offered for sale may not exactly match the actual colors due to the Internet browser screen used. The products for sale on the site whithin the limits of available stocks. If one or more items ordered are no longer available, the customer will be informed by e-mail as soon as possible. The Customer can then cancel the order for the item or items involved and be reimbursed, if applicable, any amounts already paid by crediting the corresponding price to the credit card used for payment no later than 14 bank-account days from the date the order has been cancelled.

Art. n°2 : Prices

Products' prices sold on the Site are per item and reference and are mentioned euros. The product prices are those indicated on the Site regardless of the place of delivery and including all French taxes (VAT), excluding costs port, which are borne by the client. It is precised that the customs duty and any taxes charged on delivery in certain countries in which the products are likely to be delivered, are not included in the price and are charged to the client. Any change to the rate of VAT will be reflected in the prices of items, from its entry into force. The applicable prices are the prices displayed on the Site at the time of ordering

Art. n°3 : Registration

When placing an order, you are asked to create a client account in order to be able to see your  pre-entered data and receive dedicated promotional offers. The Client should apply through a personal information form with honesty and obliged to update this information as needed. Customers must also choose an e-mail address and a password that will be requested every time they wants to access. The Customer's personal information are protected by a password so that the Customer, and he alone, has access. The company recommends Starting Blocks’ Customers to not to disclose it to anyone. The Customer must also disconnect from their profile and close the browser window after each work session, in order to prevent other users from accessing their personal information. The Client is the one responsible for the confidentiality of their password. The Customer alone bears the consequences of any unauthorized use of their password. 
According to the law of January 6, 1978, Customers have a right of access to personal data relating to them, and may use it by writing to the Customer Service address info@mi-mai.com, without prejudice to the rights they also have to oppose for good cause to the processing of the data.

Art. n°4 : Order's Steps to Complete the Sale :

  1. The Client types the address www.mi-mai.com
  2. The Customer adds item(s) to their shopping cart. 
  3. The Customer fills out the form to create an account. 
  4. The Customer verifies the elements of their order, identifies and corrects any typing errors made through the issuance of an order summary.
  5. The Customer verifies and accepts expressly the General terms of sale of MI-MAI.
  6. The Client validates the order, the total price and the price all inclusive, clicking on "Pay My Order".
  7. The Customer receives an electronic receipt that includes the elements of the order. The order will not be confirmed until payment is accepted by the Customer's bank and receipt of the amount of the order by Starting Blocks. 
  8. The Customer receives an electronic confirmation of the order. 
  9. The Client receives the parcel at the delivery address they indicated  in their order.                                                                                                                           The summary of the order will also be available on the Website in the "My Account" category "my orders". 
    All orders will be confirmed after acceptance of the payment. After the payment, an order confirmation is sent by Starting Blocks to the Customer, by email to the email address specified by the Customer. 
    Customer agrees that the bill be considered as evidence of the contractual relationship between parties. The Client will be able to print the invoice sent with the order confirmation. 

Art. n°5 : Retention of Title

Products remain the property of Starting Blocks until full payment is received for each order.

Art.n°6 : Terms of Payment

Full payment must be made when ordering. At no time payments can be considered as a deposit or deposits. No shipping in payment against delivery will be accepted for any reason whatsoever. Customers can pay their order by credit card (Visa, Eurocard / Mastercard, Amex) via the Credit Agricole secure platform or Paypal. 
Pursuant to the provisions of Article L 132-2 of the Monetary and Financial Code, a given undertaking to pay through a credit card is irrevocable. 
Any order placed on the Site implies a guarantee by the Client that they have all the necessary permissions to use payment methods available on the Site. Starting Blocks reserves the right to suspend or cancel any order if it encounters difficulties in collecting payment.

We do not store credit card information of our clients on our website.

Art. n°7 : Anti-Fraud 

Starting Blocks reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order. 
Any resale of products purchased on the Site is strictly prohibited. As such, each order is limited to a maximum total of 20 articles. 
Moreover, in order to fight against fraud, Starting Blocks has developed a device implementing exclusion lists, which can cause it to: 
(I) seek to secure the deal, some documents once payment is made, if automatic alarm is triggered by the information about the order. 
(II) block any command from a Client account previously responsible for fraud.

 

Art. n°8 : Delivery

For any order placed on the Site, we make a commitment to prepare your command in 24 to 96 hours (except for weekends and holidays) and in maximum 10 working days in period of strong activities (Christmas, sales, etc.).
When placing their order, the Customer has to choose the mode of delivery offered by e-shop site and the place of the delivery:
- Colissimo
- Pick-up in stores : 83 rue Vieille du Temple 75003 Paris, France


The Customer can ask ordered articles to be delivered to them in their place of residence, at their office, at a third person’s, on their resort, etc.
In case of error in the title of the address and phone number of the Customer, Starting Blocks cannot be held responsible for the impossibility to deliver one or several ordered articles.

In case of absence during a Colissimo delivry at the address indicated by the Customer, a calling card is normally left by the local Post: the Customer can then pick up their parcel at the post office, providing an ID card in 15 days’ time following the date the calling card was laft. After this deadline, the parcel will be sent back to the company Starting Blocks. The Customer service will then get in touch with the Customer for a possible forwarding, whose expenses are chargeable to the Customer.

When a parcel leaves the warehouses of the company Starting Blocks to be forwarded to the address indicated by the Customer when placing their order, the latter receives by electronic way on behalf of the Site a confirmation of shipment on which is indicated the tracking number of their parcel.

The Customer can follow the state of progress of the treatment (processing) of his order in their personal secured space " My account " on the Site or by going on the Colissimo website, provided with his parcel’s tracking number :

Every delivery is considered complete, as soon as the carrier has put the parcel at the Customer’s disposal, as the tracking of the parcel on the carrier’s website will attest.

If the Customer has no news of their order within the expected delivery time, they have to get in touch Starting Blocks's Customer service, which will then open an inquiry with the relevant services. Times of definitive answer from our carriers vary from one to three weeks, running from the consideration of the case by the services of the company Starting Blocks. 

If the Customer has chosen their own transporter, it must then get in touch with the said transporter.


In the event the transporter was selected by STRATING BLOCKS, the Customer can, at this stage, cancel their order with the Customer service because of the undergone delay and ask for the refund of their order. The parcel, if it is found, will be sent to Starting Blocks.
When the Customer wishes, on the contrary, to pursue their order and to receive their product despite the undergone delay:
- If the parcel is found, it is sent to the Customer: the procedure of reception then follows its normal course (direct delivery of the parcel or calling card). 
- If the parcel is declared lost (the definitive answer is often formulated within the maximal deadlines, ie three weeks), Starting Blocks then informs the Customer and commits immediately to the refund of the parcel (products and postal charges).

Are considered in particular, as case of absolute necessity releasing Starting Blocks of its obligation to deliver : war, riot, fire, flood, strikes, accidents, the impossibility to be supplied.

In any case, the delivery of our products within the deadlines can take place only if the Customer is up to date with their obligations.

It is up to the Customer to check the parcels on delivery (its aspect and weight) and to make any reserves and complaints which would seem justified, even to refuse the parcel, if this one may have been opened or if it shows obvious tracks of deterioration. The aforementioned reserves and the complaints must be sent to the Post office by registered letter with recorded delivery.

Art. n°9 : Returns

It is reminded that the legal withdrawal period in compliance with the Code of consumption is 14 true days, without having to prove any motives or to pay penalties. This deadline runs as from the reception for the Products or from the acceptance of the offer for the Services. 

Besides, without prejudice to the right of withdrawal of the Code of consumption, we propose  to the customer who would not be satisfied a deadline of thirty days as from the date of order’s confirmation, to return it and obtain the reimbursment or the exchange of products, corresponding to the amount of the already paid sums (not including the shipping fees).

 
The withdrawal period does not start to run again in case of exchange, according to the modalities planned in the article n°10.

 

Returns from France

Eshop :

To send their application for exchange or refund, the customer has to fill in the return voucher present in their parcel, with the reasons why they wishe to make a return, and to specify if they wish for an exchange or a refund (in case of definitive return).  The Product(s) must be returned in their original condition and accompanied with the voucher of return of order, to the address indicated on the voucher of return. 

In case of absence of the voucher of return inside the parcel, Starting Blocks cannot proceed to the refund or to the exchange.
The incomplete, damaged, or made dirty returned Products will not be taken back.

Do not use the item's original box as a shipping box. Any damaged item's box will lead to the refusal of the return by STARTING BLOCKS. 

The first return for exchange or reimbursment is free (except for the items of the Archives catalog, for which returns are paid by the client). The next returns (for exchange or reimbursment) are to be paid by the client.

In case of application for refund: the returned Products will be paid off to the Customer for a maximum deadline of thirty days as from their reception by Starting Blocks. Once the received Product(s) is/are checked and accepted by our services, the refund will be made by a credit of the amount to be repaid on the Customer’s bank account which was debited during the transaction.

In case of application for exchange: the newly selected product will be sent to the Customer, and the shipment costs will remain at the expense of the company Starting Blocks.

 

In our stores :

If the customer is not satisfied with the products, the customer is free to change or ask a refund in our shops in Paris (83 rue Vieille du Temple 75003).

The incomplete, damaged, carried  or made dirty returned Products will not be taken back.


Returns from abroad:

Exchanges of products are not possible for orders from abroad. To exchange a product, the customer must first return their product and ask for a reimbursment. The customer must then place a new order with the item of their choice. To send their application for refund, the customer has to fill in the return voucher present in their parcel, with the reasons why they wishe to make a return. The Product(s) must be returned in mint condition, in its/their original packaging and accompanied with the voucher of return of order, to the address indicated on the return voucher. 

In case of absence of the voucher of return inside the parcel, Starting Blocks cannot proceed to the refund.
The incomplete, damaged, carried or made dirty returned Products will not be taken back.

The returned Products will be paid off to the Customer for a maximum deadline of thirty days as from their reception by Starting Blocks. Once the received Product(s) is/are checked and accepted by our services, the refund will be made by a credit of the amount paid by the customer for the products.


The legal right of withdrawal and exchange policy do not apply to articles made according to specific requirements of the Customer or to clearly personalized articles.
The risks of returns are borne by the Customer. The Customer is thus strongly encouraged to send back the parcel by every possible means which brings the proof of its shipping and gives an assured date (recommended with acknowledgement of receipt, tracked Colissimo, etc.).

Art. n°10 : Legal Guarantees

Products enjoy guarantees of conformity and hidden defects. 
Notwithstanding the withdrawal period provided in Article 9, in the event that the goods delivered are not conform in terms of quality or quantity to the specifications made in the delivery summary, the Customer must notify the Customer Service by writing to the address the info@mi-mai.com. 
They will then receive an email with a voucher of return that they will print. Product must be returned in mint condition in their original packaging and accompanied by the return package to the address written on the return form. In the absence of the voucher return, Starting Blocks  may not proceed with the exchange of the returned product(s). Shipping costs related to the return of the product(s) will be refunded to the Client by a credit amount to be repaid on the customer’s bank account which was debited during the transaction. 
Once the product is received, checked and accepted by us, Starting Blocks will proceed with the delivery of a new product corresponding to the Customer's order and consistent with the description of the product. If the product is no longer available, Starting Blocks will notify the Customer by email and offer them to receive a credit or refund of the order of the amount of the returned product. The credit would be available under "My vouchers" in the "My Account" Customer. Reimbursement of the returned product at the invoiced price would be done by a credit amount to be repaid on the Customer’s bank account which was charged during the transaction. 
The withdrawal period does not start to run again after receipt of the new product.

 

Art. n°11: Starting Blocks' Responsibility

Starting Blocks is not responsible if the Site is inaccessible or presents any access bugs or anomalies, for whatever reason.
Starting Blocks reserves the right to put forward a third party on the Site in any manner whatsoever, and is not responsible for third party sites to which visitors are directed from the Site.

Confidentiality of personal data:

Personal data collected on the Site www.mi-mai.com are required to process the order. In an order placed on the Site by any new customer, the database is enriched with information about them, that will enables Starting Blocks, thereafter, to better meet their expectations and facilitate assistance services provided by Customer Service.

Intellectual Property Rights: 
All products and texts, comments, photos, trademarks, artwork, concept, illustrations and images from the Site are the exclusive property of Starting Blocks and are protected by intellectual property rights in France and in the world. Total or partial reproduction of these materials or the Site is strictly prohibited.


Governing Law and Jurisdiction: 
In case of translation of the Site and of the Terms and Conditions, the French language prevails for interpretation.
These Terms are governed by French law for issues. Any dispute arising from their validity, interpretation, and enforcement are subject to the exclusive jurisdiction of Paris courts’ rule, except for mandatory law procedure.
